HOA LAWS AND REGULATIONS
Federal laws - In addition to state law regulations, the federal government has laws that govern the operation of homeowners' associations, condominiums, and other residential properties in North Dakota.
North Dakota Condominium Ownership of Real Property, N.D. Cent. Code §§ 47-04.1-01, et seq.: This chapter governs condominium property formation and operation in North Dakota. A condominium project is submitted to this chapter by recording a declaration in the office of the county's recorder in which the property lies. N.D.C.C. §§ 47-04.1-02, 47-04.1-03.
North Dakota Nonprofit Corporations Act, N.D. Cent. Code §§ 10-33-01, et seq.: The law governs the corporate structure and procedure of nonprofit corporations in North Dakota. If a condominium or homeowners' association is organized as a nonprofit corporation, it will be governed by the Act. Visit the North Dakota Secretary of State to find an association's corporation status.
North Dakota Housing Discrimination Act, N.D. Cent. Code §§ 14-02.5-01, et seq.: The law protects people's right to access all housing opportunities without discrimination based on race, color, religion, sex, disability, age, familial status, national origin, or status with respect to marriage or public assistance. See §§ 14-02.5-02 through 14-02.5-08 (sale or rental, publication, inspection, entry into a neighborhood, disability, residential real estate-related transaction, brokerage services) or conduct that is an offense under § 14-02.5-45. These state-level protections are similar to the federal Fair Housing Act (FHA) and the Americans With Disabilities Act (ADA). Victims of housing discrimination may file a complaint with the North Dakota Department of Labor & Human Rights, HUD, or file a private lawsuit in federal or state court.

SOLAR EASEMENTS
North Dakota Law on Servitudes, N.D. Cent. Code § 47-05-01, et seq.: The Chapter includes numerous provisions governing wind and solar easements in North Dakota. Section § 47-05-01.1 provides property owners with a right to obtain written solar easements for exposure of a solar energy device to the sun's direct rays. North Dakota Department of Labor & Human Rights - The Commission has the authority to investigate alleged violations of housing discrimination. It may issue a charge if it concludes probable cause exists to believe that unlawful discrimination has occurred.
North Dakota Real Estate Commission - The Commission is responsible for the licensure, education, and discipline of real estate professionals.
U.S. Attorney's Office, District of North Dakota - The attorney general's office plays an important role in protecting the state's citizens. Find Attorney General Opinions.
U.S. Department of Housing and Urban Development - North Dakota - The federal agency is responsible for enforcing the federal Fair Housing Act and provides information and resources for homeowners.
HOA INFORMATION AND DOCUMENTS
Books and records ‑ Financial statement, N.D. Cent. Code § 10-33-80. Under North Dakota's law, nonprofit corporations (incorporated condominium and homeowners' associations) must keep complete copies of its articles and bylaws, accounting records, voting agreements, and minutes of members' meetings for the last six years. A member or a director, or the agent or attorney of a member or a director, may inspect all records referred to in subsections 1 or 3 for any proper purpose at any reasonable time. The corporation may charge the requesting party a reasonable fee to cover the expenses of providing copies of records under this section.
