HOA LAWS AND REGULATIONS
Federal Laws - In addition to state law regulations, the federal government has laws that govern the operation and management of common interest communities in the state of Wisconsin.
Wisconsin Condominium Ownership Act, Wis. Stat. Ch. 703. The Act governs the formation, management, operation, and powers of condominium associations formed under the Act by recording a declaration with the register of deeds of the county where the property is located.
Wisconsin Nonstock Corporations Act, Wis. Stat. Ch. 181. The Act governs nonstock corporations in Wisconsin with regard to corporate structure and procedure. Most homeowners’ associations and condominiums in Wisconsin are organized as nonstock corporations (incorporated under Wisconsin law). Visit the Wisconsin Department of Financial Institutions to check the corporate status of an association.
Wisconsin Disclosures By Owners Of Real Estate, Wis. Stat. Ch. 709. The law obligates all persons who transfer real property containing one to four dwelling units, including a condominium unit and time-share property, by sale, exchange, or land contract to disclose all information and documents outlined under sections 709.02 to 709.04 and 709.06, unless the transfer is exempt under 77.25.
Wisconsin Open Housing Law, Wis. Stat. § 106.50. The law protects people's right to have access to all housing opportunities without discrimination based on sex, race, color, sexual orientation, disability, religion, national origin, marital status, family status, status as a victim of domestic abuse, sexual assault, or stalking, lawful source of income, age, or ancestry. These state-level protections are similar to the federal Fair Housing Act (FHA). Victims of housing discrimination may file a complaint with the Wisconsin Department of Workforce Development Equal Rights Division, HUD, or file a private lawsuit in federal or state court.

Public Places of Accommodation or Amusement, Wis. Stat. § 106.52. The law prohibits discrimination against persons because of sex, race, color, creed, disability, or the presence of a service animal, sexual orientation, national origin, or ancestry in public accommodations. These protections are similar to the Americans with Disability Act ("ADA"), so its application is usually limited to publicly-accessible commons areas in the community. The law is administered by the Wisconsin Department of Workforce Development Equal Rights Division. See also Wis. Wisconsin Department of Workforce Development Equal Rights Division. The Division has the statutory authority to investigate alleged violations of housing discrimination and may issue a charge if it concludes probable cause exists to believe that unlawful discrimination has occurred. Wis. Stat. § 106.50(1s), (6)(c).
